1. Agreement to Terms

These Terms of Service ("Terms") constitute a legal agreement between you ("User," "you," or "your") and BREEZE GAME LLC ("Company," "we," "us," or "our"). By accessing, downloading, installing, or using the Ball Sort - Color Puzzle Game application and related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on your personal device for personal, non-commercial purposes only. This license does not include the right to:

  • Modify or alter the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Remove or alter any proprietary notices or labels
  • Use the Service for commercial purposes
  • Distribute, sell, or rent the Service
  • Create derivative works based on the Service
  • Use the Service to develop competing products

3. User Responsibilities

Account Creation

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

Prohibited Conduct

You agree not to:

  • Engage in any form of cheating, hacking, or exploiting the Service
  • Use bots, scripts, or automated tools to gain unfair advantages
  • Harass, threaten, or abuse other users
  • Post offensive, defamatory, or illegal content
  • Attempt to gain unauthorized access to the Service
  • Violate any applicable laws or regulations
  • Interfere with the normal operation of the Service

Age Requirement

You represent and warrant that you are at least 13 years old. If you are under 18, you have obtained parental or guardian consent to use the Service.

4. Intellectual Property Rights

The Service, including all content, features, functionality, graphics, text, images, sounds, and software, is owned by BREEZE GAME LLC or its licensors and is protected by international copyright, trademark, and other intellectual property laws.

You acknowledge that you do not acquire any ownership rights by downloading or using the Service. All rights not expressly granted in these Terms are reserved by the Company.

5. In-App Purchases

Payment Terms

In-app purchases are processed through third-party payment processors (e.g., Google Play, Apple App Store). By making a purchase, you authorize the payment processor to charge your payment method.

No Refunds

Except as required by law, all in-app purchases are final and non-refundable. Refund requests must be directed to the respective app store.

Virtual Currency

Virtual currency purchased in the Service has no real-world value and cannot be exchanged for cash or other goods.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BREEZE GAME LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF BREEZE GAME LLC FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BREEZE GAME LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

8. Indemnification

You agree to indemnify, defend, and hold harmless BREEZE GAME LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you violate these Terms or engage in prohibited conduct.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall continue in effect.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be exclusively brought in the federal or state courts located in the United States, and you consent to the personal jurisdiction and venue of such courts.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to review these Terms periodically for updates.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and BREEZE GAME LLC regarding the Service and supersede all prior and contemporaneous agreements, understandings, and negotiations.
